School districts in Texas are required by state law to assess the English language proficiency of all students whose Home Language Survey indicates that the home language is a language other than English.

If a child demonstrates limited English proficiency on the assessment, the student is considered an Emergent Bilingual (EB). The student is also considered to be eligible for enrollment in the appropriate language program: bilingual education or English as a Second Language (ESL) upon recommendation of the  Language Proficiency Assessment Committee (LPAC).  Bilingual education is only offered in PK-6th, while ESL is offered at all grade levels. The goal of both programs shall be to use instructional approaches designed to meet the special needs of English language learners.  (§89.1201. Policy.)
